905.1 Community Use of School District Facilities & Equipment

School district facilities and equipment will be made available to local nonprofit entities which promote cultural, educational, civic, community, or recreational activities.  "Entity(ies)" will include organizations, groups and individuals and their agents.  Such use will be permitted only when the use does not interfere with or disrupt the education program or a school-related activity, the use is consistent with state law, and will end no later than midnight.  It is within the discretion of the superintendent to allow for-profit entities to use school district facilities and equipment.  The board and/or superintendent reserves the right to deny use of the facilities and equipment to an entity.  It is within the discretion of the superintendent to allow use of school district facilities and equipment on Sundays.

 

Entities that wish to use school district facilities or equipment must apply with the superintendent or superintendent’s designee.  It is the responsibility of the superintendent or superintendent’s designee to determine whether the school district facility or equipment requested is available and whether the application for use meets board policy and administrative regulations.  It is the responsibility of the superintendent or superintendent’s designee to provide application forms, obtain proof of insurance (if required), and draw up the contract for use of school district facilities and equipment.

 

Use of school district facilities and equipment by entities will be supervised by a school district employee unless special prior arrangements are made with the superintendent or superintendent’s designee.  The school district employee will not accept a fee from the entity using school district facilities and equipment.  If appropriate, the school district employee may be paid by the school district.

 

Entities that use school district buildings, or equipment, or sites must leave the building or site in the same condition it was in prior to its use.  Inappropriate use of school district facilities and equipment may result in additional fees charged to, or the inability of, the entity to use school district facilities or equipment in the future. 

 

The superintendent or superintendent’s designee may allow entities, such as the Boy and Girl Scouts and 4-H, to use the school district facilities and equipment without charge.  While such entities may use the facilities and equipment without charge, they may be required to pay a custodial fee.

School buildings and facilities are available for community use at no cost provided:

1. The building's use is scheduled for the hours it is normally open and staffed.

2. No admission is charged, collected, or other attempts made to raise money.

3. The request is approved by the superintendent or their designee.

4. Permission is not sought for its regular and continued use.

5. Such use does not cause harmful alterations in the building's schedule.

6. Supervision of facilities can be accomplished by appropriate school system personnel.

7. The district incurs no direct or indirect costs for the use of the facility.

8. The use of the facility is not for an individual's personal use or for private gains, i.e., private parties, wedding receptions, etc., that would normally be held in churches or businesses in the community.

School buildings and facilities are available to nonprofit making resident citizen's groups during hours when the building is usually closed, when:

1. The request is approved by the superintendent or their designee.

2. The use of the building does not cause scheduling problems.

3. The appropriate school staff can supervise the facility.

Groups raising money for school use shall not be charged the use of school facilities.  Groups raising money for youth, but non-school activities, shall be charged only for the cost incurred by the school.

School affiliated groups or local organizations sponsoring community service programs are exempt from all charges provided no supervisory or housekeeping services are needed.  If supervision or housekeeping of facilities is necessary, the fees shall be the direct costs incurred by the school.

If it is established that the major portion of the money raised at a fundraising activity will be used for local community benefits or local charities, the fees charged shall be the direct costs incurred by the school.

All staff groups and teachers and student groups may use school facilities with prior approval of the superintendent or their designee.

A teacher and adult mixed group may use the facilities with prior approval of the superintendent or their designee, but are expected to pay the stipulated hourly rental fee for nonprofit groups.

When necessary, special arrangements regarding the cost of using the facilities may be made in the interest of a youth or community recreational activity.

Under unusual circumstances, such as an overriding community need, the superintendent may approve the use of school facilities without cost.

Adult education sponsored by tax supported educational organizations may use the facilities without cost during normal hours.  Other educational institutions will pay a fee agreed upon by the superintendent or designee.

On all matters relating to the interpretation or appeal of this policy, the board's decision will be final.

905.1R Gym/Fitness Facility Use Regulations

 

GYM/FITNESS FACILITY USE REGULATION

 

The gym/fitness facility is designed primarily to enhance learning opportunities for students. The school district recognizes that it is not the only authorized user of the gym/fitness facility and other users will frequently be using the school district’s facilities.

 

The Principal is responsible for coordinating gym/fitness facility use.  Requests for use of the gym/fitness facility shall be filed with the Principal.

 

It shall be the responsibility of the entity using the gym/fitness facility to comply with the requirements of the law and school district policy and its supporting administrative regulations.

 

EXPECTATIONS

 

Who is eligible for a key?

To be eligible for a key, each person associated with that key must participate in a formal training.  (Training TBD).

Age: A person must be 18 or have graduated from high school in order to have sole possession of a key.  Students 10-18 may be part of a family key.

Non-district individuals:  Non-district staff members and immediate family members may use the facilities and be a “key holder”. 

 

Hours

Daily from 5 AM to 10 PM

Out of town guests may get a key (short-term) by contacting the superintendent/designee.

 

Activation fee- (non-refundable)

$50 per key

 

Deactivation

Key deactivation is at the sole discretion of the superintendent or board appointed designee.  Examples of deactivation would be violation of the facility expectation guidelines, violation of the law, or any action deemed unnecessary in by the superintendent/designee.

Key holders having key deactivated will be notified via text or email.

Deactivated key holders may request in writing, at least 2 weeks before a regularly, a board hearing if they believe their key deactivation was unjust.

Keys will be deactivated based on the superintendent/designee discretion.

 

 

 

Reactivation

Those wishing to have their key reactivated must attend another mandatory facility use training.

$100 non-refundable reactivation fee (this fee may double with each reactivation)

After serious or multiple infractions, a key may be permanently terminated.

 

Use

The fitness room may only be used for the activities in which it was intended.

The gym shall only be used for exercise classes, basketball or volleyball. Other exceptions can be made through the superintendent/designee.  Exceptions will be done in writing via email.

Entry to and exit from the facility must be through controlled access points only. Other exits should be used for emergencies only.

The school is a gum, tobacco, and alcohol free.  (This includes e-cigs.) 

The facilities may be closed to members and guests for maintenance and school events.

The school reserves the right to deactivate any key for any reason.

Dry, clean shoes are a must. Proper gym/fitness center attire

Clean up

Each key holder is responsible for cleaning up after themselves and their guests and cleaning of equipment.

Exterior doors are NEVER to be propped open.

If using the facility during the winter, it is expected that you use the shovel (provided) to clear a path for others entering.

Non-profit groups are responsible for cleaning the facility (checklist).

 

Common Areas

Be respectful of the facility and courteous to others. 

No horseplay.

Clean up after yourself and guests.

Please keep hands and feet off walls, glass, and ledges.

No glass containers allowed.

8th-12th grade students are permitted to use the gym without parent supervision.  No guests are allowed without key holding parent supervision.  All other children must be accompanied by an adult family member card holder.

Personal music or screen devices must use headphones.

Put weights back on racks.

Students in 7th & 8th grade may use the facility only with key holding parent supervision.

Students in grades 9-12 must be accompanied with someone the same age or older.  (Only 1 guest per key holding student.  Guest must have signed liability waiver on record prior to use.)

The school district reserves the right to charge all costs, including attorneys’ fees, which may arise to the authorized user for the sponsored or authorized user’s failure to comply with the law, board policy and administrative regulations.

905.1R1 Use of School District Facilities Regulation

  1. There shall be no alcoholic beverages brought to or consumed in the buildings or on the grounds.
     
  2. There shall be no smoking in school facilities [or on school grounds].
     
  3. A custodian, superintendent or designee must be present while the facility is being used.
     
  4. After a school building has been used by an outside group, cleaning will be done by employees assisted by a committee from the outside group.  Fees for such work will be charged to the group as part of the rental fee charged for the use of the building.

In addition to paying the above fees, each renter must make arrangements with the school district to have adequate janitorial and supervisory services.  Buildings will not be available unless a contract is signed by the renter and the school district well in advance of scheduled usage.

905.1E2 Community Use of School District Facilities & Equipment Indemnity and Liability Insurance Agreement

COMMUNITY USE OF SCHOOL DISTRICT FACILITIES & EQUIPMENT INDEMNITY AND LIABILITY INSURANCE AGREEMENT

The undersigned, hereafter referred to as "entity," states that it will hold the Schleswig Community School District, hereafter referred to as "school district," harmless from any and all damages and claims that may arise by reason of any negligence on the part of the entity in the use of any facilities or equipment owned by the school district.  In case any action is brought therefore against the school district or any of its officers, employees or agents, the entity will assume full responsibility for the legal defense thereof, and upon its failure to do so on proper notice, the school district reserves the right to defend such action and to charge all costs, including attorneys' fees, to the entity.

The entity agrees to furnish and maintain during the usage of the facilities or equipment owned by the school district such bodily injury and property damage liability insurance as will protect the entity and the school district from claims or damages for personal injury, including accidental death, and from claims for property damages which may arise from the entity's use of the school district's facilities or equipment whether such operations be by the entity or by anyone directly or indirectly employed by the entity.

The entity will furnish the school district with a certificate of insurance acceptable to the school district's insurance carrier before the contract is issued.

905.1E3 Schleswig Gym and Fitness Center Use Agreement

SCHLESWIG GYM AND FITNESS CENTER USE AGREEMENT

 

IT IS HEREBY AGREED BY AND BETWEEN, the Schleswig Community School District [hereinafter, District] and the undersigned [hereinafter, Patron

(including businesses in the Schleswig CSD for use for employees only)], as follows:

  1. Patron agrees to pay a one-time non-refundable key card issuance fee of $50 to the District. The key card permits access to the District’s gymnasium and fitness center [hereinafter, Center]. Access to the Center, other than for attendance at District events, is not permitted during the school day or during periods of other District use without permission from district administration.
  2. Patron acknowledges that there will be no supervision of the use of the Center by Patron or Patron’s guests.
  3. Patron acknowledges that the District will track his or her use of the Center by logging when Patron’s key card is used to access the Center and by use of video cameras or other means.
  4. Patron acknowledges that he or she has been trained by the District in the safe use of the Center and in the safe use of equipment in the Center. Patron further acknowledges receipt of the Center’s rules and expectations and agrees to abide by them and any subsequently adopted rules and expectations.
  5. Patron agrees that his or her use of the Center entails inherent risks associated with such use, including but not limited to risk of physical injury from improper use of equipment in the Center, and risks inherent in physical exercise. Patron acknowledges that he or she is solely responsible to protect himself or herself and his or her permitted guests from risk of injury at all times when using the Center or its equipment.

  6. Patron does hereby release, acquit, and forever discharge District, together with its past and present officers, directors, employees, related and affiliated entities, successors, agents, heirs, assigns, and insurers, and all other persons, firms and corporations, from any and all liability whatsoever, including all claims, demands, and causes of action of every nature affecting Patron, jointly or severally, which has, may have, or ever claim to have arising out of Patron’s use of the Center.
  7. Patron acknowledges that this Agreement may be amended from time to time at the sole discretion of the District. Patron further agrees that his or her right to access the Center may be revoked at any time by the District for violation of the rules and expectations of the Center or for any other reason deemed sufficient by the District.

905.1R1 Community Use of School District Facilities & Equipment Regulation

(1) Use of tobacco/nicotine/vaping on school property shall not be allowed, including in private vehicles.

(2) There shall be no alcoholic liquors or beverages brought to or consumed in the building or on the grounds.

(3) When a school building is being used, cleaning will be performed by school employees assisted by a committee from the outside group.  Labor for such work will be charged to the group through the fee charged for building use.  When additional custodial and supervisory personnel are needed for setup, cleanup, supervision, etc., an additional charge per hour may be added to defray such expenses.

(4) Personnel assigned to supervise a building for non-school activities may be requested to perform special school jobs if activities of the non-school groups do not require their attention. 

(5) Applications for the use of school facilities should be made through the activities director, superintendent or their designee.  All users are required to sign a rental agreement.

 (6) All groups using school facilities must have responsible adult supervision present at all times to assure proper care and use of school property.  A principal or qualified responsible school employee on paid or volunteer status must be in attendance to unlock, supervise and re-lock the facility each time it is used for non-school purposes.  Supervisors must be present during the duration of the activity.  Exceptions to this policy must be written on the rental contract.

(7) The school may request damage deposits.  All damages to school property shall be repaired and billed to the sponsoring individual or organization.

(8) Users are responsible for the facilities and are responsible for any breakage or damage that occurs.  Users are responsible for the proper control of activities and persons using school facilities and equipment so that all safety factors are observed.  Users are responsible for the correction of minor and easily correctable safety factors and are asked to report all others immediately or on the next working day, as warranted, to the principal.

(9) Users agree to hold the district harmless from any and all liability arising out of the user’s negligence or omissions while using the school facilities or equipment.

(10) Business, non-profit and/or for-profit groups and individuals may be required to furnish a certificate of liability insurance prior to the execution of the rental contract.

(11) School buildings and grounds will be available only during the time listed on the contract.  Likewise, only those buildings and grounds listed on the contract will be available, and activities should be confined to the stated area.

(12) The serving of food in school buildings by a commercial caterer is permitted, but must be first approved by the business office and stated in the rental contract.  If school kitchen facilities or equipment are to be used, appropriate food service personnel of the school will be present at all times.   The wages of such personnel shall be part of the fees charged for the use of the facility.

(13) The school reserves the right to adopt and enforce additional rules and regulations as may be deemed appropriate in individual cases.

(14) All persons participating in physical education or athletic activities will wear approved gymnasium shoes.  Food and drinks will be permitted in designated areas only.

(15) Moving and adjusting scenery, securing lighting effects, operating the public address system, and similar matters will be accomplished under the direction of a designated school employee.

(16) All properties not belonging to the school are to be removed after the last performance or the day after use of school facilities.

905.1R2 Fees for Use of School District Facilities

Rates for Rental of Facilities

 

All parties wishing to request use of any part of the school facilities will complete the required forms. This application can be obtained at the District Office. Completed forms must be turned in to the District Office well in advance of scheduled usage and must be approved by the superintendent or superintendent’s designee prior to facility use.

There may be fees assessed for the use of school facilities as well as supervisory, janitorial, maintenance, or other services that may need to be provided by the school personnel. These fees are outlined below.

 

Groups: May be charged a usage fee of up to $500/day.

Security Deposit: The district reserves the right to request a security deposit of up to $500. This deposit is fully refundable if the facilities are left in the same condition they were rented in. Any cleaning or damage fees will be deducted from this deposit.

Maintenance/Supervision: If it is necessary to assign a district employee for supervision or maintenance, an hourly fee of up to $100/hour may be charged.

 

An estimate of fees will be recorded on the facilities use request form. All required fees and deposits will be paid prior to the date of the requested use. Checks should be made out to Schleswig Community School and turned in to the District Office. Refund of deposits will be made within ten (10) business days of the facility use.

 

The superintendent will be responsible for setting fees. Additional fees may be charged if an event incurs more cleaning/maintenance than planned for or if there is damage to district property.

All equipment is to be used as designed.  No horseplay.

Workout attire must be worn.  No jeans or open toed shoes.

No glass containers

Personal music or screen devices must use headphones.

Put weights back on racks.

Wipe down/disinfect all equipment after use.

Clean up after yourself and guests.

Students in 7th & 8th grade may use the facility only with key holding parent supervision.

Students in grades 9-12 must be accompanied with someone the same age or older.  (Only 1 guest per key holding student.  Guest must have signed liability waiver on record prior to use.)

The school district reserves the right to charge all costs, including attorneys’ fees, which may arise to the authorized user for the sponsored or authorized user’s failure to comply with the law, board policy and administrative regulations.

905.2 Tobacco/Nicotine-Free Environment

Tobacco and nicotine use is prohibited on school district facilities and grounds, including school vehicles.  This requirement extends to students, employees and visitors.  This policy applies at all times, including school-sponsored and non-school-sponsored events.  Persons failing to abide by this request are required to extinguish their smoking material, dispose of the tobacco, nicotine or other product or leave the school district premises immediately.  It is the responsibility of the administration to enforce this policy.
